Brussels Planning Code reformed

30 May 2018

In the Belgian Official Journal of 20 April 2018, the long-awaited ordinance reforming the Brussels Planning Code was finally published. With this new order, the Brussels regional government aims to simplify the urban planning rules in the Brussels-Capital Region and render it more flexible.

Real estate lease law reform in Walloon region

10 April 2018

In the Belgian Official Journal of 28 March 2018, two Walloon decrees on lease law were published, having been approved by the Parliament of the Walloon Region on 15 March 2018:

  1. The Decree of 15 March 2018 on short-term retail lease ('décret relatif au bail commercial de courte durée et modifiant le code civil')
  2. The Decree of 15 March 2018 on the lease of domestic accommodation ('décret relatif au bail d'habitation').

This is an important new step towards the regionalisation of specific lease regimes. In this newsflash, Laga explains the main characteristics of the two decrees.

Belgium to introduce (optional) VAT on immovable letting

28 July 2017

Immovable letting has always been exempt from VAT in Belgium since the introduction of the VAT system. Within the framework of budgetary discussions, the Belgian government has decided to abolish this VAT exemption and introduce a regime allowing the landlord to opt to apply VAT to the immovable letting.

Reduced VAT renovation rate: transitional measures until 2017

3 December 2015

As from 1 January 2016, the reduced VAT rate of 6% will only apply on buildings older than 10 years instead of the current 5 years. The Belgian Finance Minister foresees transitional measures for buildings aged between 5 and 10 years.

Constitutional Court: absence of real estate buyers’ right to withdraw is legal when sale is outside the seller’s premises

5 October 2015

One of the protection measures in consumer law is to grant consumers the right to withdraw when signing an agreement outside the (professional) sellers’ premises. The law reserves this protection specifically for consumers of services and movable property when the sale takes place outside the company’s premises. In the case that led to the Court’s ruling, a question was raised on whether the distinction made with regard to immovable property buyers, to whom the right to withdraw is not granted by law, is constitutional.

Walloon government adopts implementing decisions further to the Decree on commercial establishments

28 May 2015

On 5 February 2015, the Decree concerning commercial establishments was adopted by the Walloon Parliament. This Decree has been implemented by the Walloon government through four decisions.

  • The first decision further elaborates upon the criteria for granting or refusing permits.
  • The second decision establishes the composition and operation of the Commerce Observatory and the Appeal Committee.
  • The third decision establishes the procedural rules attached to the application for a permit.
  • The fourth decision confirms the competent officials’ appointment.

The Decree as well as the decisions implementing it will enter into force on 1 June 2015.

Does financial consumer protection apply to real estate investments?

8 January 2015

The FSMA offers clarifications on when real estate investments can qualify as investment instruments.

There are many rules in financial regulation that aim to protect financial consumers. The Prospectus Directive, which was established to protect the public and ensure the market’s efficiency, applies to " investment instruments " as defined in Article 4 , § 1 of the Law of 16 June 2006. In a 13 November 2014 communication, the FSMA addressed the cases in which real estate investments can qualify as investment instruments and the consequences thereof.
