Het verdrag van Lissabon : een echte bres in de ontslagmacht van de werkgever?

The Treaty of Lisbon has entered into force on 1 December 2009. It may have important consequences for the Belgian legal rules relating to the dismissals of employees in the private sector. Indeed, it can  be argued that as of 1 December 2009 employees are entitled to know why their employer are considering dismissing them. Furthermore, the employee may have the right to be heard before the employer takes the actual decision to dismiss the employee. Up until now, Belgian employers, in the private sector, had no legal obligation to motivate dismissals or to hear the employee before a dismissal.
