Foreign nationals allowed to perform volunteer work

A draft law allowing foreign nationals to perform volunteer work in Belgium has been approved by the Belgian Senate on 10 December 2009.

No lump sum valuation of mobile phone benefits

In our newsflash of 7 December 2009, we announced the approval of a draft Royal Decree by the Council of Ministers relating to the valuation of the benefit in kind for the private use of mobile phones (cell phone, Blackberry etc.) granted by the employer. The government has, however, recently reconsidered its decision and withdrew the draft Decree.

Nous avions également situé la date probable d’entrée en vigueur de ce projet d’arrêté royal au 1er avril 2010. Le Conseil des ministres vient toutefois de revenir sur sa décision et de le retirer.

In onze newsflash van 7 december 2009 hadden wij de goedkeuring door de Ministerraad gemeld van een ontwerp van koninklijk besluit met betrekking tot de wijze waarop het voordeel van het privégebruik van een toestel voor mobiele telefonie (GSM, Blackberry, etc..) voor de berekening van de sociale zekerheidsbijdragen gewaardeerd diende te worden. Wij hadden eveneens de vermoedelijke datum van inwerkingtreding van dit ontwerp van koninklijk besluit op 1 april 2010 bepaald. De Ministerraad komt echter terug op haar beslissing en trekt dit ontwerp terug in.

Om in België tewerkgesteld te kunnen worden, moeten werknemers van buiten de EG gemachtigd worden tot een verblijf in België van meer dan 3 maanden en dit door middel van een aanvraag van een visum type D.

A partir du 1er avril 2010, tout indépendant doit être affilié à une caisse d’assurance sociale pour indépendants ou à la Caisse Nationale Auxiliaire au plus tard le premier jour du début de l’activité. Ils ne bénéficieront plus désormais d’un délai 90 jours pour s’affilier.

Self-employed workers to join social insurance fund at the latest on the first day of activities: no April Fool's joke

As from 1 April 2010, all self-employed workers have the obligation to join one of the social insurance funds for self-employed persons or the National Fund no later than the first day of their self-employed activity. They will no longer benefit from the transitory period of 90 days to do so as was the case in the past.
